GLOBAL PRIVACY AND COOKIE STATEMENT

Since its founding in 1992 by Ed Kloppenburg, our family business has grown into one of the largest B2B toy wholesalers in the Netherlands, with a global reach. Today, under the leadership of Barry Kloppenburg (CEO) and Manja Kloppenburg, we supply business customers all over the world. Growth and innovation are our priorities, but always while maintaining reliability and transparency. This applies to our products, but naturally also to the way we handle your (company) data.

This privacy statement applies to all international online activities and webshops of Wholesale Holland, including (but not limited to):

In this statement, we explain what data we collect, why we do this, and how our systems are designed to guarantee your privacy from the first click. 1. What data do we collect and why?

Because we primarily focus on the business market (B2B), we mainly process company data. Please note: data of sole proprietorships and partnerships, as well as data of individual contact persons within larger organizations (such as a name and a business email address), do count as personal data by law. These are handled by us with the utmost care in accordance with the General Data Protection Regulation (GDPR) and applicable international legislation.

  • When using our webshop (Purchase & Delivery):
    To process your B2B orders, we collect master data such as the company name, contact person's name, billing and delivery address, email address, telephone number, VAT number, and payment details. We use this data exclusively to execute the agreement with you.
  • Customer Service:
    When you contact us (via email, telephone, or a form), we register the content of your message and your contact details to handle your request quickly and adequately.
  • Newsletters & B2B Updates:
    We like to keep existing business customers informed about relevant (new) collections and offers (soft opt-in). You can object to this at any time via the unsubscribe link at the bottom of every email. If you are not a customer, we will only send you a newsletter if you have given explicit prior consent.
  • Prevention of abuse and fraud:
    To keep our international trading platform safe, we check orders for irregularities based on our legitimate business interest. This process is secured and personal characteristics are pseudonymized as much as possible. If an order is rejected for this reason, you can always contact us for a human reassessment.

2. Privacy by Design: Cookies & Tracking

We believe in an honest online experience. Therefore, we use a 'Zero-load' policy. This means that we respect your privacy and by default do not place any tracking or analytical cookies when you visit our website until you explicitly choose to do so.

2.1. Necessary cookies & Local storage (Always active)
To allow our webshop to function technically, we use functional cookies. These remember, for example, the contents of your shopping cart or your language preference. In addition, we store your privacy choice (accepting or not accepting tracking) locally on your own device (via localStorage under the name cookie_consent). As a result, you do not have to provide your preference again with every page view. This process does not share data with us or third parties.

2.2. Analytical cookies
To optimize our international websites, we use Google Analytics 4 (GA4). By default, this system is completely blocked ('denied'). Only when you explicitly click "Accept" in our cookie banner is tracking activated ('granted'). Do you choose "Decline" or ignore the banner? Then tracking remains completely disabled and we do not measure your visit.

2.3. External Media (YouTube / Vimeo)
We regularly show product videos on our website. To prevent external video platforms from placing unsolicited (third-party) tracking cookies on your device, we have blocked these videos by default behind a secure overlay (placeholder).

  • You can give one-time permission via this overlay. The video is then loaded via a privacy-friendly connection (e.g., youtube-nocookie.com).
  • Do you not want to accept cookies, but still want to see the video? Then we offer a secure, direct link in the overlay to view the video directly on the external platform (such as youtube.com).

2.4. Withdrawing or changing your consent
Because we work with the aforementioned system and store your choice locally on your device, our cookie banner disappears after you have made a choice. We do not use a permanent settings button on the website. Do you want to withdraw or change your previously given consent? Then you must clear the cookies and website data (local storage) of your specific internet browser. Upon your next visit to our website, the banner will then reappear, with all tracking set to 'declined' by default again.

3. Sharing data with third parties & International transfer

Wholesale Holland never sells, rents, or trades your data to third parties for commercial purposes. In order to deliver your order worldwide and offer our services, we share necessary data exclusively with carefully selected partners (such as logistics partners for track & trace, payment providers, and IT service providers). We conclude strict data processing agreements with these parties.

Because we operate internationally, data may in exceptional cases be processed outside the European Economic Area (EEA). In that case, we guarantee that this only happens to countries with an adequate level of protection or using model contract clauses (Standard Contractual Clauses) approved by the European Commission.

4. Retention periods and Data Security

We do not store your data longer than is strictly necessary. For master and order data, we apply the legal (fiscal) retention obligation of 7 years. Inactive customer accounts are safely deleted or anonymized after a continuous period of inactivity of 5 years. We secure our systems with modern, common encryption standards (such as TLS) to encrypt the transfer of sensitive information and protect it against unauthorized access.

5. Your Basic Privacy Rights (Worldwide / EU GDPR)

As a data subject, you have various rights under European privacy legislation (and similar international laws). You have the right to:

  • Access the personal data we process about you.
  • Have your data rectified (corrected) or deleted.
  • Restrict the processing of your data or request your data in a structured format (data portability).
  • Right of objection: You have the right at any time to object to the processing of your data based on our legitimate interest or against processing for direct marketing (newsletters).
  • Withdrawing consent: As described in section 2.4, you may always withdraw granted consent for cookies or media.

Do you want to exercise your rights? Please send an email to sales@wholesaleholland.com. To prevent abuse, we may ask you to identify yourself adequately. EU residents also have the right to file a complaint with the Dutch Data Protection Authority (AP) or the supervisory authority in their own country.

6. Additional Regional Provisions (International)

6.1. For residents of the United Kingdom (UK GDPR)
For our British customers, we process data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. International transfers from the UK to the EEA are based on adequacy decisions established by the British government. British residents have the right to file a complaint with the Information Commissioner's Office (ICO).

6.2. For residents of the United States (CCPA/CPRA & State Laws)
This section applies to residents of US states with specific privacy legislation, such as California, Virginia, and Colorado. Wholesale Holland hereby confirms that we have not sold or shared your personal data in the past 12 months for cross-context behavioral advertising ("Do Not Sell or Share My Personal Information"). We collect data exclusively for the business purposes as described in section 1. You have the right to access the specific pieces of personal information we have collected about you, and the right to non-discrimination when exercising your privacy rights. Requests for this can be submitted via sales@wholesaleholland.com.

6.3. For residents of Canada (PIPEDA / Law 25)
In accordance with the Canadian PIPEDA (and the specific legislation in Quebec), the contact details mentioned in section 7 also serve as a contact point for our designated Privacy Officer. You have the right to request access to, or demand correction of, your personal information in our files.
